Case No. CJ-2014-1545-W NOTICE OF SHERIFFS SALE OF REAL ESTATE Notice is hereby given to the following entities, being all of the defendants and persons holding or claiming any interest or lien in the below described property whose interests therein are sought to be extinguished by these proceedings: (1) Tommy A. Howard, aka Thomas A. Howard; (2) Linda Sue Howard, fka Linda Sue Gattenby; (3) Discover Bank; (4) Greenbriar Kingsridge Homeowners Association, an Oklahoma Corporation; (5) Tinker Federal Credit Union; and (6) United States of America, ex Rel., The Small Business Administration; that pursuant to a Special Execution and Order of Sale With Appraisement issued out of the District Court of Cleveland County, State of Oklahoma, on or about July 17th, 2015, in an action wherein MidFirst Bank, a federally chartered savings association, is Plaintiff and Tommy A. Howard (aka Thomas A. Howard), et al, are defendants, directed to the Sheriff of Cleveland County, State of Oklahoma, commanding him to levy upon and sell with appraisement the following described real property situated in Cleveland County, State of Oklahoma, to wit: Lot Thirty-Six (36), in Block Three (3), in Greenbriar Kingsridge Section 2, to the City of Oklahoma City, Cleveland County, State of Oklahoma, According to the Recorded Plat Thereof, Together with all rights, easements, appurtenances, royalties, mineral rights, oil and gas rights, all water and riparian rights, ditches, and water stock and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be part of the real estate described above (Property") (the Property has a street address of 1324 Southwest 111th Place, Oklahoma City, OK 73170), to satisfy the judgment and decree of foreclosure in favor of Plaintiff, obtained and made in said Court on the 15th day of June, 2015, on its causes of action wherein the Court found that there was due and owing MidFirst Bank the sum of $17,365.02, plus interest accruing on the unpaid principal balance of 6.70% per annum ($2.95 per day) from December 3, 2014 through the date of judgment, plus all of its miscellaneous expenses incurred and to be incurred by Plaintiff (to include $1,750.00 for abstracting/title evidence), plus all property preservation expenses incurred and/or to be incurred by Plaintiff (to include any sums advanced for taxes or insurance), plus an attorneys fee of for this action of $3,000.00, plus all prejudgment costs, plus all accruing postjudgment costs, the balance of which remains unpaid. Pursuant to this Notice of Sheriffs Sale, said Sheriff will on the 16th day of September, 2015, at the hour of 10:00 oclock a.m. of said day in Room 200 of the Cleveland County Office Building, 201 South Jones Avenue, Norman, Oklahoma 73069, offer for sale and sell to the highest bidder for cash, the said property above described, or as much thereof as will satisfy said judgment with interest, costs and attorneys fees, subject to: (1) Ad valorem real estate taxes on said property having statutory priority by law (with $8,317.09 reportedly owed as of July 2, 2015); and (2) The senior mortgage in favor of the Administrator of the Small Business Administration, an agency of the United States of America, dated June 25, 1999, and recorded June 30, 1999 (MERS Mortgage), in Book 3075, Pages 232-237, in the original principal amount of $94,800.00, and assigned by the SBA to Mortgage Electronic Registration Systems, Inc. by the Assignment of Mortgage recorded with the Cleveland County Clerk at Book 3534, Page 1138. Plaintiff MidFirst Bank estimates the MERS Mortgage payoff to be approximately $44,000.00. Said Property has been appraised for the sum of $170,000 (Property Value), with the real value of the owners rights and interest in said Property (i.e., owner net equity) being appraised/estimated at the amount of the Property Value, less $52,317.09.
