NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: June 8, 2015 Name of Responsible Entity (RE) City of Duquesne Address 1501 S. Duquesne Road, Joplin, MO 64801 Telephone Number of RE 417-781-5085 On or after, June 16, 2015, the City of Duquesne will submit a request to the State of Missouri Department of Economic Development for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), to undertake the following project: Project Title: Street/Road Project Purpose: The City is proposing street repair/paving and restoring due to the 2011 tornado that destroyed homes and businesses within the City. Immediately after the event, the City initiated the expedited debris removal (EDR) effort to clear debris from the tornado damaged areas. The equipment used in the EDR effort produced heavy pavement loads and stresses beyond the original design of the residential pavements. Furthermore, these loads were applied repeatedly to these pavements for many weeks until the EDR effort was complete. Due to the increased traffic and heavy equipment all roads within the city limits are in need of some level of repair. Location: Throughout the City of Duquesne Estimated Cost: Proposed CDBG Funding $2,000,000 Total Project Estimated Cost: $2,001,500. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at City Hall, and may be examined or copied weekdays 8:00 a.m. to 5:00 p.m., Monday through Friday. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Duquesne City Hall, 1501 S. Duquesne Road, Joplin, MO 64801. All comments received by June 15, 2015, will be considered by the City of Duquesne prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The City of Duquesne certifies to the State of Missouri that Lisa Daugherty, in her capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State of Missouri's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Duquesne to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS The State of Missouri will accept objections to its release of funds and the City of Duquesne's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of City of Duquesne; (b) the City of Duquesne has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the State of Missouri; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the State of Missouri Department of Economic Development, Community Development Block Grant, at PO Box 118, Jefferson City, MO 65102. Potential objectors should contact the State of Missouri Department of Economic Development to verify the actual last day of the objection period.
