IN THE DISTRICT COURT OF WOODWARD COUNTY STATE OF OKLAHOMA Case No. CJ-2015-55 CBM MORTGAGE AND FINANCIAL SERVICES, LLC Plaintiff, vs. BRADY ROBERT EVANS, DONNA RUTH EVANS, COUNTY TREASURER OF WOODWARD COUNTY, OKLAHOMA , BOARD OF COUNTY COMMISSIONERS OF WOODWARD OKLAHOMA, Defendants. SECOND ALIAS NOTICE OF SHERIFF’S SALE NOTICE is hereby given that pursuant to a Special Execution and Order of Sale with Appraisement issued out of the District Court of Woodward County, Oklahoma, directed to me, the Sheriff of Woodward County, Oklahoma, commanding me to levy and sell with appraisement the following described real property situated in Woodward County, Oklahoma. The undersigned Sheriff will, on the 8th day of February, 2016, at the hour of 10:00 a.m. of said day at 1600 Main, Woodward County Courthouse in the City of Woodward, Oklahoma, offer for sale and sell to the highest bidder for cash in excess of two-thirds (2/3) of the appraised value of the following property or so much thereof as will satisfy the Judgment of CBM Mortgage and Financial Services, LLC, together with attorneys’ fees, interest and all costs accrued and accruing: Lots One (1), Two (2), Three (3) and Four (4) in Block Twelve (12) in the Original Town of Fort Supply, Woodward County, Oklahoma, as shown by the recorded plat thereof; The Real Property has an appraised value of $25,000.00. Sale will be made pursuant to Order of Sale issued to satisfy the in personam judgment of CBM Mortgage and Financial Services, LLC, against the Defendants, Brady Robert Evans and Donna Ruth Evans, for default of the Promissory Note dated December 7, 2007, and in rem judgment for default of the Mortgage dated December 7, 2007, to satisfy the Judgment of the Plaintiff and the lien of the Defendants as follows: 1. To the payment of the costs of said sale in this action; 2. The principal amount of $10,979.74 as of March 4, 2013, prejudgment interest thereon at the daily rate of $8.83 from March 4, 2013, through the date of entry of the Journal Entry of Judgment, together with all abstracting expenses, property preservation expenses, escrow expenses, late charges, inspection expenses, recording expenses, insurance premiums, taxes, assessments and all other expenses incurred prior to or during the pendency of this action, or may be hereinafter advanced by CBM Mortgage and Financial Services, LLC; and, attorneys’ fees and costs including poundage upon sale, and all fees, costs, and expenses incurred prior to or during the pendency of this action in the amount of $2,609.20, or may be hereinafter advanced by CBM Mortgage and Financial Services, LLC, as the result of any bankruptcy instituted by any party Defendant, for all of which let execution be issued; and 3. That the residue, if any, to be paid to the Clerk of this Court to await further Order of this Court. WITNESS my hand this 5th day of January, 2016.
